Does my chatbot have to tell users it is AI?

Under Article 50(1) of the EU AI Act, providers must design AI systems intended to interact directly with people so that those people are informed they are interacting with an AI system. The duty has a carve-out where it would be obvious to a reasonably well-informed and observant person given the circumstances, but relying on that carve-out is a judgement call — an explicit disclosure is the lower-risk position.

Does the EU AI Act chatbot rule apply to a UK business?

It can. Article 2 extends the Act to providers and deployers established in a third country where the output produced by the AI system is used in the Union. A UK company running a support or sales chatbot that serves users in the EU is in scope, regardless of where the business or its servers sit. A chatbot serving UK users only is outside the Act, though UK consumer protection and advertising rules still apply.

When did the Article 50 transparency duties start applying?

For chatbots serving people in the EU, they have applied since 2 August 2026. The Regulation entered into force in 2024 with its obligations phased in, and the Chapter IV transparency duties, which include the chatbot disclosure in Article 50(1), took effect on that date.

What counts as adequate chatbot disclosure?

The Regulation states the outcome required — the person must be informed they are interacting with an AI system — rather than prescribing wording, and the accompanying Code of Practice is the reference point for how that is demonstrated in practice.
